The Social Magas provides integrated digital marketing, branding, content creation, social media management, influencer marketing, web development, CGI/3D visualization, and performance marketing services. All services are governed by signed proposals, contracts, or retainers specifying scope, timelines, and fees.
2. Client Eligibility & Minors
Our services may involve digital engagement channels operated by individuals under 18. By using our services for such accounts, you confirm that a parent or guardian has provided consent. We do not verify age independently and are not liable for unauthorized engagement by minors.
3. Intellectual Property
- All content, designs, creative assets, software, logos, and related deliverables produced by The Social Magas remain our intellectual property unless expressly transferred via agreement.
- Clients are granted a limited license to use deliverables for agreed purposes only.
- Unauthorized reproduction, resale, modification, or distribution of any materials is strictly prohibited.
4. Client Responsibilities
- Provide accurate and timely materials, information, and approvals.
- Ensure proper authorization for any data, content, or accounts submitted to us.
- Respect project scope, timelines, and agreed-upon processes.
5. Payments & Fees
- All fees are defined in proposals or agreements.
- Invoices must be paid per the agreed schedule, typically 50% advance and 50% upon delivery, unless otherwise stated.
- Late payments may incur interest or project delays.
6. Project Timelines & Delays
Estimated delivery dates are outlined in project scope documents. Delays caused by client inaction, content delays, or failure to provide approvals may extend timelines without penalty to The Social Magas.
7. Refunds & Cancellations
Due to the creative nature of our services, refunds are not provided once work has commenced. Cancellation is permitted prior to project initiation or via mutual written agreement. Any payments made for work completed will be non-refundable if work has started.
8. Confidentiality
Both parties agree to keep confidential all sensitive information, trade secrets, proprietary data, or any information shared during project execution. Confidentiality obligations survive termination of services.
9. Data & Privacy
We only collect and process data voluntarily provided by clients or publicly available on social media. All personal information is handled in accordance with our Privacy Policy. Clients are responsible for ensuring that all data submitted to us has appropriate consents and permissions.
10. Limitation of Liability
The Social Magas shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of our services.
- Delays or issues resulting from client-provided content, access, or approvals.
- Failures of third-party platforms, hosting services, social media networks, or tools outside our control.
- Data publicly available or submitted without proper consent.
11. Termination
Either party may terminate services upon written notice. Termination does not relieve clients of outstanding payment obligations. Deliverables completed up to the termination date will be provided, and no further obligation beyond agreed scope applies.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in the NCT of Delhi. The parties agree to attempt an informal resolution before initiating litigation.
13. Changes to Terms
The Social Magas reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with the revised date. Continued use of services constitutes acceptance of the updated Terms.
